1. Overview of Services
This Agreement is entered into between JWARDMUSCLE ("Coach," "we," "us") and the undersigned client ("Client," "you") for online personal training and coaching services.
1.1 Services Included
Depending on the selected program (Starter, Premium, or Elite), services may include:
- Customized training programs designed for your specific goals
- Nutrition coaching and macro guidelines
- Access to training app with exercise demonstrations
- Regular program updates and adjustments
- Direct messaging support (varies by program)
- Video check-in calls (Premium and Elite)
- Form check video reviews
- Progress tracking and accountability
1.2 Services NOT Included
- Medical advice, diagnosis, or treatment
- Physical therapy or rehabilitation services
- Psychological counseling
- Supplements or meal delivery services
- In-person training sessions
2. Program Terms & Payment
2.1 Program Duration
- Starter & Premium: Minimum 3-month commitment
- Elite: Month-to-month (no minimum)
2.2 Payment Terms
- Payment is due on the first day of each billing cycle
- Payments are processed automatically via the payment method on file
- All payments are in USD unless otherwise specified
- Late payments may result in service suspension
2.3 Pricing
- Starter: $149/month
- Premium: $249/month
- Elite: $449/month
Pricing may be updated with 30 days written notice. Current clients are grandfathered at their existing rate for the duration of continuous enrollment.
3. Client Responsibilities
The Client agrees to:
- Provide accurate and complete information about health history, current fitness level, and goals
- Disclose any medical conditions, injuries, or limitations that may affect training
- Obtain physician clearance before beginning any exercise program if recommended
- Follow the prescribed program to the best of their ability
- Complete check-ins and progress updates as scheduled
- Communicate openly about challenges, concerns, and questions
- Maintain safe exercise practices and proper form
- Not share, distribute, or resell program materials
4. Health & Safety Waiver
4.1 Assumption of Risk
The Client acknowledges that:
- Physical exercise involves inherent risks including but not limited to: muscle strain, sprains, fractures, cardiovascular stress, and in rare cases, death
- The Client voluntarily assumes all risks associated with the exercise program
- Results vary and are not guaranteed
4.2 Medical Clearance
The Client affirms that:
- They are in good physical condition and have no known medical conditions that would prevent safe exercise participation
- They have consulted with a physician if they have any concerns about their ability to exercise safely
- They will immediately inform the Coach of any changes to their health status
4.3 Release of Liability
To the maximum extent permitted by law, the Client releases and holds harmless JWARDMUSCLE, its owners, employees, and affiliates from any and all claims, damages, losses, or injuries arising from participation in the coaching program.
5. Refund & Cancellation Policy
5.1 30-Day Satisfaction Guarantee
New clients may request a full refund within the first 30 days if not satisfied with the program, provided they have:
- Completed all assigned workouts
- Followed nutrition guidelines
- Submitted all required check-ins
- Communicated any issues with the Coach
5.2 Cancellation
- Cancellation requests must be submitted in writing at least 30 days before the next billing date
- Minimum commitment periods must be fulfilled before cancellation takes effect
- No refunds for partial months
- Upon cancellation, access to programs and materials will be revoked
5.3 Pausing Membership
Clients may request to pause their membership for up to 30 days per year for vacation, illness, or unforeseen circumstances. Pause requests require 7 days advance notice.
6. Intellectual Property
All training programs, materials, templates, and content provided are the intellectual property of JWARDMUSCLE. The Client may not:
- Share, distribute, or sell any program materials
- Reproduce content for commercial purposes
- Share login credentials with others
Violation of these terms may result in immediate termination without refund.
7. Communication & Privacy
7.1 Communication
Coach will respond to messages within the timeframe specified for your program level:
- Starter: Email support within 48 business hours
- Premium: App messaging within 24 hours
- Elite: Priority response within 2 hours (during business hours)
7.2 Privacy
Client information, photos, and data will be kept confidential and will not be shared without explicit written consent. See our Privacy Policy for details.
8. Testimonials & Success Stories
With client permission, progress photos and testimonials may be used for marketing purposes. Clients may opt out at any time by providing written notice.
9. Dispute Resolution
Any disputes arising from this Agreement shall be resolved through:
- Direct communication between Client and Coach
- Mediation by a mutually agreed third party
- Binding arbitration if mediation fails
10. Modifications
This Agreement may be modified by Coach with 30 days written notice. Continued use of services after modifications constitutes acceptance of updated terms.
11. Entire Agreement
This Agreement constitutes the entire agreement between Coach and Client regarding online personal training services and supersedes all prior agreements.
Agreement Acknowledgment
By signing below, I acknowledge that I have read, understand, and agree to all terms and conditions outlined in this Coaching Agreement.
